Brenton was admitted as a solicitor in 2015 and practises in the areas of commercial litigation, dispute resolution, debt recovery and insolvency.

Brenton spent time in the in-house dispute resolution team of a large, privately-owned group of companies, but has since been in private practice.

Brenton has acted for a broad range of clients, in a diverse range of litigation and insolvency matters, ranging from small contractual disputes through to complex commercial litigation in superior Courts.

Experience

Brenton’s past insolvency matters have included:

  • Acting in numerous winding up applications and creditor's petitions, including applications running concurrently with lower Court proceedings to set aside judgment.
  • Acting on an application to set aside a bankruptcy notice on the basis of substantial error, run concurrently with three Local Court matters to set aside garnishee orders.
  • Advising on and responding to unfair preference and insolvent transaction claims, responding to applications by administrators appointed after commencement of winding up proceedings, and seeking stay/dismissal of winding up applications under Section 440A of Corporations Act.

Brenton’s past litigation matters have included:

  • Having carriage of a large range of debt recovery litigation, varying in complexity, with debts ranging from $500 to $500,000 (while employed in an in-house role).
  • Acting in complex commercial litigation, generally regarding the supply of building products and services, including:
    • Queensland Supreme Court proceedings involving allegations of defective work done by a builder.
    • New South Wales Supreme Court proceedings involving allegations of breach of contract and improper dealing with confidential information.
    • New South Wales Supreme Court proceedings regarding a $2.5M commercial loan, with complications regarding the documentation of the loan and the relevant limitation period for recovery.
  • Acting in proceedings relating to enforcement of a director’s guarantee and whether a debt was provable in a liquidation, where the relevant company had been deregistered.

He has experience in representing clients in most State and Federal Courts, including:

  • Magistrates/Local Courts in New South Wales, Victoria, Queensland, Western Australia, South Australia, and the Australia Capital Territory.
  • District/County Courts in New South Wales, Victoria, Queensland, Western Australia, and South Australia.
  • Supreme Courts in New South Wales, Victoria, Queensland, and Tasmania.
  • Federal Courts including the Federal Circuit & Family Court of Australia, and the Federal Court of Australia.
  • State Tribunals including NCAT, and NTCAT.
