Silvana has been practising since 2004 and is an experienced commercial litigator in both the public and private sectors in Australia. Silvana has advised on contentious and non-contentious matters and has conducted large-scale litigation in all superior Courts.

Silvana has acted in proceedings in the Supreme Courts of New South Wales and Victoria, the Courts of Appeal in New South Wales and Victoria, the Court of Criminal Appeal in New South Wales, the Land & Environment Court of New South Wales, the Federal Court of Australia, and the High Court of Australia.

Silvana has acted on behalf of clients against ASIC in relation to investigations and contested prosecutions being conducted by ASIC, as well as the execution of Crimes Act search warrants.

Silvana has advised insolvency practitioners in relation to all forms of external control, including administrations, receiverships and liquidations. She has acted in all manner of commercial disputes, including claims against directors for breach of directors’ duties, shareholder disputes, and disputes with local government authorities.

Experience

Silvana’s past insolvency and litigation matters have included:

  • Acting for the plaintiffs in proceedings in the Supreme Court of Victoria in a claim against receivers in connection with their sale of a significant commercial asset at an alleged undervalue.
  • Acting in Federal Court of Australia proceedings brought by ASIC against Storm Financial, the CBA, the Bank of Queensland and Macquarie Bank regarding the giving of financial advice to investors that was inappropriate to their personal circumstances.
  • Acting in proceedings commenced by ASIC in relation to alleged contraventions of Section 601ED of the Corporations Act.
  • Advising on criminal matters brought by ASIC in which a conviction was successfully appealed to the Court of Criminal Appeal and the conviction was quashed.
  • Acting for the voluntary administrators in relation to ABC Learning Centres.
